Genestealer hybrid Ork ! New Sculpt

Hello , I use to post my miniatures on the WIP section, so I'm gonna do it here now in case someone missed before.
Its another miniature for my upcomming set , in this case a Hybrid ork , I thought after my chaotic freebooterz would be cool
to create another "special" final ork.

Really nice, so what about that kickstarter?? I thought one was coming in February, but it's already march!
I thought I was over Orks after what GW has been releasing in the past decade or two, but seeing all your stuff takes me back to the good old days when I bought my first army, Space Orks of course :mrgreen:
 
How do you plan to get around the copyright infringement? Will you just do it and wait for the C&D letter, or have you got permission, or what? Im not trying to wind you up here, its a serious question!

I would suspect that unless GW could show a specific piece of art that is copied from, there is no issue. There are a lot of other companies that GW hasn't touched doing orcs that are similar to theirs.

Although, lack of right has never been known to stop companies from sending out C&D letters!
 
Wow, Diego, this one is so cool! :!: Some time ago I made some conversions for a friend who was getting a Kult, but I didn't get even close to this awesomeness! I'll tell him, for sure he'll like this one :)
 
The trouble is....you have published it now in a public forum SAYING implicitly that you are stealing their IP, that is using an idea from GW, that is calling it a genestealer ork hybrid. Using the "k" in orc and genestealer means it was INTENTIONALLY made to infringe on their IP. See this is going to be the problem with selling "Oldhammer" models, as they are basically and fundamentally "knicking" an idea.

I love the sculpt and thin you should definitely go ahead with casting and selling it. HOwever I am really interested to see if GW can or will do anything about it. If they dont or cant, then it means alot more of the Oldhammer concept models can go ahead.

But you're allowed to be inspired by other copyrighted works when creating your own. In other words, you can knick all the "ideas" you want because you can't copyright an idea. No matter how many public forums you go to and say I made an ork-genestealer hybrid. As long as you don't use any thing they've created (what is clearly a genestealer claw, for example), you've not infringed a copyright. The only possibly protectable thing that I saw was the pistol, which might look too similar to a gw plasma pistol. But those are a lot of expensive lawyer hours for a sci fi gun.

That said, using the terms "ork" and "genestealer" might be a trademark issue. But even ork might be a tough sell to a judge.

Further to that, GW don't have ORK or GENESTEALER currently registered (in the UK, as far as I can see).

Ork is the spelling of Orc in Dutch and German and was also Tolkiens preferred spelling later in life, pretty much the same territory as with Spots the Space Marine trying to claim ownership, although arguably the case would be stronger with miniatures.

Genestealer, well yeah. maybe. Or maybe biology has caught up with gene stealing concept and it is now in common enough use to describe certain biological functions in a generic, non-protectable way.

Anyway, it's a nice niice Alien-Orc Hybrid Diego - you're really nailing those late 80s ork faces!
