Fimm's painted models

AHH yes, the 'sneeze and loose a few minis' skellies, I remember them well. I love the mouth open head for some reason. Used it as often as possible.
Hated the spears, just had to look at them and they would snap.
A few arms may have snapped at the shoulder in this process…

Having said that they have survived over three decades of abuse, so could be worse!
 
They were a generous gift from a leading player in the Oldhammer community.
I believe there are some recast versions of some of them floating around ebay from time to time, someone must have got hold of castings.
 
Last thing I heard of them was >10 years ago, when a bag containing one of each proto-prototype was found in a plastic bag in the Ansell collection.
I've seen one (nicely but kinda meh) painted set and now yours (which look way better!). I guess no-one can tell now who has the 'original' set or how many versions of Ansell's bag are still out there
This is one instance where I wouldn't mind someone producing good quality molds and just recasting them over the internet. They're great minis and they've never been released officially, so is copying them even violating any rights?
 
Oh, there would have been a bunch cast in the studio so 'original' would only apply to the greens. though.. erm.. "Is copying them even violating any rights" Yes. very much so. In fact, I'm not 100% sure about in Miniatures, but for TV shows in the UK, getting unreleased (never aired) TV shows released is WAY harder then shows which DID air. copyrights, permissions etc.

They were sculpted by Citadel studio, so they have the copyright. Personally, I would give some copyright to the sculpture by the way many ones like them work is 'you made it for the company, so copyright is with the company'. so basically.. 125 years from creation (mid 1980s), 50 years from commercial publication (never commercially released) IF published within 75 years of creation.

basically.. if something was released, it has a shorter (possible) copyright duration then if it was never released. However, there is a thing on some items that it's 70 years after author's death (with books, I think it also includes works of art, so sculpts.. that is when THEY own it, but if it's a company, its a bit different, and I think the longer ones). If for some reason (and it's a no chance) the copyright is still with the sculpture.. Most of them are Jes Goodwin and he is very much still alive.

one can argue that many 'homages' that are commercial released, depending on how close they are, violate rights too. How some companies get away with dead on stuff when the IP for miniatures IS sold but others have it, I have no clue.

Point is, in a court of law GW wouldn't need knowledge, they'd need proof.
Unreleased minis means there's no sales or ads or packaging -i.e. no proof for copyright claim.
Without the original greens/masters, there only would be statements/testimonies - most likely by persons somehow involved with GW in the past or present, which would make their statements kinda susceptible to assault in court.
Provided someone were indeed as bold to just start selling these minis online, I reckon they just might get away with it, considering the difficulty of actually proving something that everyone knows its true.

erm.. naw.. Citadel was pretty good at keeping the greens/masters and it would be an easy case for them. Evolution of ideas would work, the fact that Jes Goodwin still works for Citadel, there internal records.. It wouldn't even get that far to get to a court of law. You kinda need to past a few stages to get that far (in the UK atleast). Start with a kind C&D, before moving on to less kind C&D, which is part of Initial contact, then you can start thinking about hearings and stuff but.. from what I know about the indexing and internal cataloguing at times, these ones are clearly documented.

Anyway, there are more experienced people to show the chain and talk about Citadels internal logs (I don't know if @dieselmonkey, being that he worked in a few ways for them could give you a bit more info on that side. But there would be way more stuff on Citadels side then anyone else. Also, if you want to talk about assault in court on witnesses.. yeah.. if any lawyer was stupid enough to take up a defence against citadel in such a case, I doubt they can give enough evidence that they weren't citadel.. people watch too much Perry Mason.

anyway.. getting a bit off topic ^_^ and probably into realms the forum would be better away from on the legal side
 
I guess the only possibility is that they went with Bryan along with things like the unreleased Citadel wizards, fishmen and the Feudal/historical ranges which Foundry have now released. In which case you could argue the IP sits with Foundry and they can do what they like with them.
 
So are BOYL this year, people are gonna be bothering.. erm.. Diana is it? about seeing it is possible that Foundary might release some of the rarer nice prototypes and other unreleased figures from Brian's Archives? Either the website is a bit... well, still pretty out of date cause I do kinda hear about figures they sell which aren't on the site and I'm not gonna be able to get up there any time soon (and I don't believe I'm close enough to family up there to ask them to visit ^_^ nor can I say to anyone else to get me stuff cause I don't know WHAT they have which is not on the site etc..
 
Foundry website is definitely not fully up to date. I try not to press Diane, Marcus and the family into anything, it's not been the easiest 5+ years for them. When BOYL started up Marcus was really good at digging through Bryan's stash finding unreleased models to put out each year, but circumstances got difficult and it's understandable he's not had the energy or desire to dig through the vaults.
 
Agree ^_^ Looks like they are still having to move but still not 100% on where.. They are quite nice for what they do since they are pretty small (in the terms of staff as to my knowledge) and putting more stress on people is never a great thing. Pressure? maybe a bit but stress? nope.
